ARTICLE 1 - ORGANIZER

MARKETLUCK, a limited liability company (société par actions simplifiée) with a capital of 150,000 euros, is registered with the RCS Paris (Business and Companies Register) under the registration number 803829688 with its headquarters located at 13-15 Avenue de la Métallurgie 93200 Saint-Denis, France.

Hereinafter, “MARKETLUCK”

The organizing company is the publisher of an application for smartphones and tablets.

Hereinafter, the “Application”

Through this application, MARKETLUCK provides users with a free-to-play game, without any obligation to make a purchase.

Hereinafter, “The Game”

The Application and all rights attached are the exclusive property of MARKETLUCK. All trademarks, logos and other distinctive symbols reproduced on the Application are the exclusive property of MARKETLUCK, and as such are protected by the provisions of the French Intellectual Property Code (Code de la propriété intellectuelle). Any non-authorized reproduction of these trademarks, logos and symbols constitutes a copyright infringement liable to prosecution.

NB: Apple is not one of our sponsors and is not involved with the prizes on offer in any way. The prizes are not connected with Apple products.

ARTICLE 2 - CONDITIONS OF ENTRY - REGISTRATION

2.1 Conditions of entry

Any individual person over 18 years of age, with the exception of employees of the company and their families, are allowed to register and play the Application (hereinafter, the “Participant”).

Any person who registers with the Application acknowledges to having read and understood these rules and agrees to comply with them in their entirety.

2.2 Registration

No registration is necessary to participate in the Game.

Each Participant shall be identified by the IP address of the smartphone or tablet for which the Participant is recognized to be the usual user.

ARTICLE 3 - DESCRIPTION OF THE GAME

BRAVOLOTO is a game which requires each Participant to select and enter 5 numbers between 1 and 48, and 2 astrological star signs from amongst the 12 signs, upon the condition that they view a promotional video before they are allowed to participate in the Game.

The winning combinations are drawn by lot. Each Participant who has selected one of the winning combinations will receive the highest prize associated with the numbers and signs that they saved. For example, a Participant who correctly guessed 5 numbers and 1 sign:

§ will only receive the prize corresponding to the 2nd combination (5 numbers and 1 sign);

§ and will not receive either the prize corresponding to the 5th combination (4 numbers and 1 sign) nor the prize corresponding to the 6th combination (4 numbers and 0 signs).

ARTICLE 4 - PROGRESSION OF THE GAME

The Participant opens the Application and watches some promotional material, for example a video. If this is video content, it cannot exceed 3 minutes in length.

Once the advertising content has been viewed, the Participant is allowed to play.

The Participant can play from Monday to Sunday. The Participant can play as many times as desired, up to a maximum of 100 grids per day.

ARTICLE 5 - THE DRAW

There are two Bravoloto draws every day:

– one at 12:45 pm CET for grids played between 8:46 pm the prior evening and 12:44 pm the same day

– one at 8:45 pm CET for grids played between 12:46 pm the prior afternoon and 8:44 pm the same day

The results are announced 1 hour after the draw.

The draw is carried out by the bailiff’s office at SCP SIMONIN – LE MAREC – GUERRIER, Huissiers de Justice Associés, 54 rue Taitbout 75009 PARIS.

ARTICLE 6 - COMBINATIONS

Once the result of the draw is known, the winning status of a combination is established. The order in which the numbers appear in a combination does not matter.

The winning combinations are as follows:

1st combination (Jackpot): 5 numbers + 2 signs

2nd combination: 5 numbers + 1 sign

3rd combination: 5 numbers + 0 signs

4th combination: 4 numbers + 2 signs

5th combination: 4 numbers + 1 sign

6th combination: 3 numbers + 2 signs

7th combination: 4 numbers + 0 signs

8th combination: 2 numbers + 2 signs

9th combination: 3 numbers + 1 sign

10th combination: 3 numbers + 0 signs

11th combination: 1 number + 2 signs

12th combination: 0 numbers + 2 signs

13th combination: 2 numbers + 1 sign

14th combination: 2 numbers + 0 signs

15th combination: 1 number + 1 sign

16th combination: 0 numbers + 1 sign

17th combination: 1 number + 0 signs

Each combination corresponds with a prize that is described in the “prizes to be won” page of the application.

ARTICLE 7 - PRIZES

7.1 Rules applicable to the Jackpot (see 1st combination)

The Jackpot is subject to change on a daily basis. The prize amount can be found on the “prizes to be won” page of the app

If a player wins the 12:45 pm Jackpot draw, the Jackpot amount will remain the same for the 8:45 pm draw of the same day. For example, if a player wins the 50,000 euro Jackpot in the 12:45 pm draw on a Saturday, the 8:45 pm Jackpot on the same Saturday will also be 50,000 euros.

7.1.1 In the event of no winning combinations

If at the end of the lottery draw, there are no Participants who have entered the 1st combination, then the prize pool is put back into the game, increasing after each draw by an amount determined by MARKETLUCK.

7.1.2 In the event of a winning combination

7.1.2.1 In the event of only one winning combination

In cases when only one Participant enters the 1st combination, the entire Jackpot prize pool is allocated to that Participant.

Moreover, if the Participant has entered the 1 st Combination several times in the same draw, they will only win the Jackpot once.

7.1.2.2 In the event of multiple winners

In cases where several Participants enter the 1st Combination in the same draw, each winning combination allows each Participant to claim an equal share of the Jackpot.

- If X Participants enter the 1st Combination (once each), then each Participant receives 1/X of the Jackpot. For example: If three Participants enter the 1st Combination (once each), then each Participant will obtain 1/3 of the Jackpot.

If one or more Participants enter the 1st Combination several times, then a share of the Jackpot will be allocated to each Participant, calculated in proportion to the number of 1st Combinations each Participant has entered. For example: if two Participants enter the 1st Combination, and the first Participant enters it only once, but the second Participant enters it four times, then the first Participant receives 1/5 of the Jackpot, while the second Participant receives 4/5 of the Jackpot. 7.1.2.3 Payment

Any user who has won a prize in cash (row 1 and 2 of the jackpot and row 1,2 and 3 of the megajackpot) must make himself known to the Bravoloto team (by email or telephone) within 15 days after the "day of the winning draw" to provide its banking details. If the user does not send its bank details , the winnings will be lost and no claims will be accepted.

7.1.2.3 Payment of cash prizes

Any user who has won a Jackpot, Superjackpot or Megajackpot Tier 1 cash prize will be contacted directly by telephone and by email by the Bravoloto team to congratulate them and to explain to them the stages required for the payment to be made correctly and smoothly. The winner must provide their documentary evidence within 15 days. Where necessary, a final email will be sent to them 3 days before their prize expires.

If the player has not completed their information in the "Profile" tab, the Bravoloto team will, consequently, have no means of contacting them. In this case, it is the player's responsibility to make contact by email to claim their prize.

Any user who has won a Jackpot, Superjackpot or Megajackpot Tier 1 cash prize must complete their player profile in the Application and enter the information required (see Article 9.1) in our payment tool within 15 days. In all cases, if the win is not claimed within the time limits specified, the winner will lose the prize permanently without any recourse. In this event, no claim will be accepted.

7.1.2.4 Referral bonus

If a player signs up, after being referred by a friend, and wins the Jackpot Division 1 prize or Mega Jackpot, then the person who referred the winner receives 10% of the total win. There are no restrictions on the number of applicable Jackpot wins.

Example: Player A is referred by Player B. Player A wins 1,000,000 euros in the Mega Jackpot. Player B receives 10% of the total win, in other words 100,000 euros. If several players are referred by the same player and they all win the jackpot in the same prize draw, then the person who referred them will receive 10% of each referred person’s winnings.

7.2 Rules applicable to other combinations

7.2.1 General rules

Prizes No. 2 to No. 15 comprise money, gift vouchers or “Bravo Points” rewards. The value of these prizes is determined as described on the page: “prizes to be won”

These prizes will not be shared, regardless of the number of winners (for example, if two participants correctly enter combination 2, they will both win this prize).

When these prizes come in the form of gifts, they are awarded as gift vouchers, with the prize details being indicated in the Application.

A “gift voucher” is a voucher that gives you a reduction on the price of a product on condition you spend a certain amount.

Any photographs or graphic representations depicting the products or services identified as gifts are for illustrative purposes only and are not contractually binding.

In the event that it is impossible to provide a gift identical to that shown in the Application during the organization of the Game, MARKETLUCK reserves the right to substitute it with a similar gift, of a similar monetary value to the original gift, without the winner being able to claim any kind of loss.

Bravo Points obtained by a player after the draw can be used later in the “Prizes Store” and traded for prizes: ad-free grids, Mega Jackpot tickets and gift vouchers.

Bravo Points are cumulable over several draws. The player can use them at the time of their choice, as long as they have enough Bravo Points to trade for their chosen gift.

If a player is inactive for more than 30 days, they will lose all the Bravo Points in their account.

7.2.2 In the event of winning combinations

7.2.2.1 In the event of a single winner

In the event that a single Participant has registered a winning combination, then they will win the total prize associated with this combination.

More specifically, if this Participant has registered X times for the same winning combination, on the same day, then the following rules apply:

- For combination No. 2: the Participant only receives the prize associated with this combination once.

- For combinations No. 3 to No. 15: the Participant obtains X times the prize for this winning combination.

For example:

- If the prize for combination No. 11 equals 150 Bravo Points

- If the participant enters this winning combination ten times on the same day:

- Then the participant will receive 1500 Bravo Points

7.2.2.2 If there are several winners

At the exception of conditions described in the following paragraph, in the event that several Participants enter the same winning combination in the same draw, then each of these Participants will win the total prize corresponding to the winning combination.

For example:

- If the prize for combination No. 11 equals 150 Bravo Points

- If the participant enters this winning combination ten times on the same day:

- Then the participant will receive 1500 Bravo Points

7.2.2.2.1 Particular cases on ranks 2, 3 and 4

Rank 2 : from 5 winners and more, all the winners share 5000 euros : each wins 1000€ or less. For example, if 10 players win, each wins 500€.

Rank 3 : from 8 winners and more, all the winners share 1000 euros : each wins 125€ or less.

Rank 4 (only for players based in France) : in case there are more than 10 winners at rank 4, the winners will share a global envelope of 250€.

If the winners are from countries which use different currencies, the currency conversion will be calculated according to the exchange rate that is current on the day of the win.

7.2.2.3 Prizes to choose

In certain divisions, players can choose a prize from a list containing several prizes.

7.2.2.4 Offer of the day

When the win is an “Offer of the day" (signaled by a special icon on the “Prizes to be won” page), the prize is subject to change after each prize draw. The prize that is chosen by the winner is determined at the moment they claim their prize.

7.3 Special event: MegaJackpot

7.3.1 To be able to participate to the Mega Jackpot

To be able to participate to the Mega Jackpot, the user must win Mega Jackpot tickets (called "Ticket").

To obtain a Ticket, the user may:

- Refer a friend via the "sponsor my friends" tab during a pre-specified period (the sponsor receives a Ticket when the sponsored person has installed the Application);

- Win a Ticket, as a gift, as part of the Bravoloto Game.

In addition, all 150 grids played, the user will receive a Ticket (all the grids played are taken into account, including those played prior to the date of the Mega Jackpot period).

Lastly, each referred player will receive a Mega Jackpot ticket as a reward the first time they connect to the application.

Each Ticket obtained allows the Participant to play a grid of the Mega Jackpot

7.3.2 Rules applicable to the Mega Jackpot

The Mega Jackpot is a special jackpot that is put into play in addition to the regular Jackpot. To win the Mega Jackpot it is necessary to obtain the combination n°1, meaning 5 numbers + 2 signs.

As part of the Mega Jackpot, other combinations will also allow users to win financial prize. The modalities will be specified for each Mega Jackpot. During the duration of the Game, one or more Mega Jackpots may be put into play.

The Participants, in possession of one or more Tickets, will be able to play these Tickets until 8 pm CET on D-Day. The draw of the Mega Jackpot will take place on D-Day at 9 pm CET.

It is specified that if no winner gets the Mega Jackpot, the amount will not be put back into play. The rules applicable to Combinations 1, 2 and 3 of the Mega Jackpot are the same as those provided for the Jackpot in Articles 7.1.2.1 and 7.1.2.2 of this Regulation.

The Mega Jackpot prizes are subject to change on a daily basis. The prize amounts can be viewed on the “prizes to be won” page of the app

7.3.3 Mega Jackpot day example

A Mega Jackpot is organized for a particular day.

The Participant can try to obtain Tickets to play in the Mega Jackpot on that particular day, up until one hour and one minute before the draw.

For example: If a prize draw takes place on May 14th, 2017 at 9pm, the Participant can try to obtain Tickets up until May 14th, 2017 at 7.59pm.

A Participant who has one or several Tickets, can take part in the Mega Jackpot by playing up until one hour prior to the prize draw.

7.3.4 Payment of cash prizes

Any user who has won a Jackpot, Superjackpot or Megajackpot Tier 1 cash prize will be contacted directly by telephone and by email by the Bravoloto team to congratulate them and to explain to them the stages required for the payment to be made correctly and smoothly. The winner must provide their documentary evidence within 15 days. Where necessary, a final email will be sent to them 3 days before their prize expires.

If the player has not completed their information in the "Profile" tab, the Bravoloto team will, consequently, have no means of contacting them. In this case, it is the player's responsibility to make contact by email to claim their prize.

Any user who has won a Jackpot, Superjackpot or Megajackpot Tier 1 cash prize must complete their player profile in the Application and enter the information required (see Article 9.1) in our payment tool within 15 days. In all cases, if the win is not claimed within the time limits specified, the winner will lose the prize permanently without any recourse. In this event, no claim will be accepted.

7.4 Special event: Referral operations

Referral operations are regularly held online in the application to reward users.

The users who refer the most people will be rewarded according to the conditions specified on the page dedicated to the operation, which can be viewed on the “Invite a Friend” page.

Only friends referred by players who have played at least 10 grids will be counted.

If the number of friends referred by two or more players is equal, then the player whose friends have filled in the most grids obtains the highest score.

Only one participant per telephone number or physical address will be accepted. In the event that several players have used the same address or telephone number, the entry of the player with the highest number of grids played will be chosen. Referral of fake accounts is prohibited. Players who make referrals to fake accounts will be excluded from the competition and will not be entitled to claim any prizes.

The scores will be published and updated in real time on the application’s dedicated page throughout the operation. Marketluck reserves the right to disqualify any user who attempts to alter or affect the operation’s outcome through fraudulent behavior or any other kind of misuse. Prizes will be credited to users’ accounts within ten days following the operation.

7.5 Special Operations in Division 2

In the event that Marketluck decides to reward Division 2 with prizes other than cash, for instance a vacation, telephone or gift voucher for an internet site etc. Marketluck reserves the right to choose the gift, within the limits of the value announced on the “Prizes to be won” page.

e.g. An iPhone 7 worth up to 800 euros max.

Marketluck will choose the iPhone 7 of its choice with a value as close as possible to 800 euros, the remainder will not be considered owing to the player.

The “Bravoloto pays your rent” and “Double your salary” operations mean that in the event of a win then BRAVOLOTO will reimburse your monthly rent or home loan payment, or will pay the winner an additional month of salary upon presentation of proof of earnings for the month in question: net pay slip, rent receipt or amortization schedule for a home loan in your name.

Example 1: If you earn €1545 net in April 2017 and win the “Salary X 2” prize on April 22nd. BRAVOLOTO will make a payment of €1545 into your bank account.

Example 2: If you pay €800 each month in rent, then BRAVOLOTO will make a payment of €800 into your bank account.

If a player wins the Jackpot at 12.45pm, the Jackpot total remains the same at 8.45pm of the same day.

For example, if a player wins a Jackpot of 50,000 euros on a Saturday at 12.45pm, the Jackpot on Saturday at 8.45pm will still be 50,000 euros.

7.6 Special Operation "Super Jackpot" from the 1st of May 2019

7.6.1 Participating in the Super Jackpot

In order to participate in the Super Jackpot, the Participant must win Super Jackpot tickets (the “Ticket”)

In order to receive a Ticket, the Participant may:

- By playing Jackpot grids. The Participant will receive one Super Jackpot Ticket after 11 Jackpot grids have been played, a second one after 15 Jackpot grids have been played, and a third one after 20 Jackpot grids have been played within the same Jackpot draw. After each Jackpot draw, the counter is reset to 0 and the player can once again start winning Super Jackpot Tickets once 11, 15 and 20 Jackpot grids have been played.

- By purchasing a Super Jackpot Ticket in the prize store.

Every Ticket received allows the Participant to play one Super Jackpot grid.

7.6.2 Rules applicable to the Super Jackpot

The Super Jackpot is a special jackpot that is drawn in addition to the regular Jackpot and the Mega Jackpot.In order to win the Super Jackpot you need to successfully enter combination No. 1, that is to say, 5 numbers + 2 star signs.

The Super Jackpot prizes are subject to change on a daily basis. The prize amounts can be viewed on the “prizes to be won” page of the app

In the Super Jackpot there are also other combinations which let the user win a monetary prize. These combinations are specified for each Super Jackpot.

During the Game, there may be one or multiple Super Jackpots played. Participants who have one or more Tickets can play these Tickets until 9:44pm on the day of the draw. The Super Jackpot draw will take place at 9:45pm on the day of the draw.

It is noted that if nobody wins the Super Jackpot, the latter will not be put back into the prize pool.

The rules applicable to combinations No. 1 and No. 2 of the Super Jackpot are the same as those laid down for the regular Jackpot in articles 7.1.2.1 and 7.1.2.2 of these rules.

7.6.3 Payment of cash prize

Any user who has won a Jackpot, Superjackpot or Megajackpot Tier 1 cash prize will be contacted directly by telephone and by email by the Bravoloto team to congratulate them and to explain to them the stages required for the payment to be made correctly and smoothly. The winner must provide their documentary evidence within 15 days. Where necessary, a final email will be sent to them 3 days before their prize expires.

If the player has not completed their information in the "Profile" tab, the Bravoloto team will, consequently, have no means of contacting them. In this case, it is the player's responsibility to make contact by email to claim their prize.

7.7 Special Operation "Money Time!"

From the 4th of January 2018, MARKETLUCK will be giving away a CASH prize to one player at 20:15 CET/CEST Jackpot draw.

After each Jackpot draw, an instant winner will be selected from among the qualified players, based on the following criteria:

- Player is present during the Live draw (to be connected at the time of the draw is considered sufficient)

- Player has at least 10 grids entered in the draw

- player has completed his profile (at least his first name, family name and email)

- player’s country is France,Spain,Germany or Belgium

Money Time comprises two stages:

- The selection of a prize from a list of prizes:

* 10 prizes of 10 euros in cash

* 3 prizes of 20 euros in cash

* 2 prizes of 50 euros in cash

* 1 prize of 200 euros in cash

- The selection of a player from among all those who qualify

The prize winner will be announced at the end of Money Time.

The winner must contact the Bravoloto team (by email or telephone) within 15 days of their win to provide their bank details. If they fail to do so, their win will be considered unclaimed and their claim will be null and void.

ARTICLE 8 - PUBLICATION OF RESULTS

Bravoloto lottery results are made known to the public via the Application.

ARTICLE 9 - PROVISION OF PRIZES

9.1 General rules

To receive the prize, the winner must have completed their player profile in the application: surname, first name, home address, date of birth, email address (and telephone number, optional).

To make the payment, the winner will be directed to our payment tool where the following information will be requested from them: photograph of the winner's bank account details and ID (identity card, driving licence or passport), IBAN number and photograph of the winner with permission to use it on all of Marketluck's marketing platforms (internet and social media).

All this information is mandatory in order to be able to verify the winner's identity and to make the bank payment.

Payment shall be made once the identity of the winner and compliance with these clauses have been verified.

Winners shall receive confirmation of their prize in the form of a notification via the Application.

9.2 Rules applicable to the Jackpot and MegaJackpot

For Jackpots of over €20,000 and less than €75,000, MARKETLUCK will send the winners their prizes in regular installments over a period of 24 months (it shall be stated that the first installment shall be transferred within 30 business days from the date of the draw in question).

For Jackpots equal or greater than €75,000, MARKETLUCK will send the winners their prizes in regular installments over a period of 36 months (it shall be stated that the first installment shall be transferred within 30 business days from the date of the draw in question).

For Jackpots of less than €20,000, MARKETLUCK will send the winners their prizes in a single payment of the total prize within 90 business days from the date of the draw in question.

The payment shall be made after verifying the winner’s identity and full compliance with the rules.

Payment of prizes by MARKETLUCK shall be made by bank transfer, using the bank account details provided by the winner to MARKETLUCK.

9.3 Rules applicable to other combinations

9.3.1 Monetary prizes

MARKETLUCK will send the winners their prize within 30 business days from the date of the draw in question.

The payment shall be made after verifying the winner’s identity and full compliance with the rules.

Payment of prizes by MARKETLUCK shall be made by bank transfer, using the bank account details provided by the winner to MARKETLUCK.

9.3.2 Gifts

MARKETLUCK will send winners their prizes (vouchers that may be either with or without conditions based on the division) within 24 hours at the latest, after the draw takes place.

Winners will receive the Voucher corresponding to their prize through the Application. This Voucher must be used within 30 days following its reception. Vouchers that are not used within this timeframe become invalid and will not be put back in the draw.

As an exception, certain Vouchers must be used within a shorter timeframe.

This timeframe will be indicated in the Application, in the section, “Prizes to be won”. This timeframe takes precedence over any other specified in the rules. In addition, only one Voucher may be used per payment. Therefore, if a winner has two Vouchers, they must be used for two separate payments.

9.3.3 Ad-free grids

Winners who earn an ad-free grid are allowed to play a grid without watching an advertisement first. The grid they earn must be used during the duration of the Game.

ARTICLE 10 PERSONAL DATA

10.1 Applicable rules

By using the Service, you acknowledge and agree to the processing of your personal data by MarketLuck, in accordance with the applicable law and the stipulations of the Privacy Policy.

Personal data may be requested from Participants.

Participants have a right to access, amend, rectify and update their personal data, and a right to object to the collection of their personal data.

Participants can exercise these rights, subject to proof of identity, by writing to the following address: MARKETLUCK, 13-15 Avenue de la Métallurgie, 93210, Saint-Denis, France.

10.2 Additional information

The personal data of Participants is intended for MarketLuck and, where applicable and subject to the explicit authorisation of the Participant, for certain commercial partners.

MarketLuck may send commercial communications, or have them sent by a third party, in relation to MarketLuck services identical to those already provided.

Personal data may also be disclosed to an authorised third party in the event of a judicial or administrative request.

In addition, the service provider responsible for Customer Services may have access to personal data for the purposes of its support activities in relation to the operation of the Game, however, it shall not be authorised to use said data for other purposes.

ARTICLE 11 MISCELLANEOUS

The Participant can obtain grids without adverts by referring friends to the Game.

ARTICLE 12 - RESPONSIBILITIES

In the event that the Participant is unable to connect and/or play, that their information has been lost, or that a bug during the submission of the combination causes the combination not to be saved, MARKETLUCK cannot be held responsible, in particular if the problems arise due to an unfavorable IT environment, an incorrect configuration of the Participant’s IT equipment (in particular a technical fault or a malfunction of the communication networks) or of difficulties arising from the Internet or cellular phone network.

The Participant understands and accepts that when required, particularly in the event of maintenance works, technical breakdown, violation of automatic data processing systems or difficulties arising from the Internet or cellular phone network, access to the Application may be temporarily suspended or even permanently stopped.

ARTICLE 13 - AUTHORIZATION TO USE THE NAMES OF WINNERS

Each winner authorizes MARKETLUCK to use their first name and zip code, without restriction or reservation, and without any remuneration, entitlement or benefit whatsoever, other than the awarding of their prize.

A picture of each winner may be used free of charge by MARKETLUCK, in the form of a photograph or video, pending confirmation that the winner is in agreement.

ARTICLE 14 - CASES OF FRAUD

Any fraud or attempted fraud, manifested by a commencement of execution and committed to perceive undue gain or to participate in the lottery in an illegal manner, will be subject to prosecution under the provisions laid out in Article 313-1 of the French Criminal Code.

ARTICLE 15 - LEGAL FILING

The rules are filed with SCP SIMONIN - LE MAREC – GUERRIER, Huissiers de Justice Associés, 54 rue Taitbout 75009 PARIS.
